An Ames teen has pleaded not guilty in a case involving alleged sexual exploitation of a minor.
The case involves 18-year-old Diing Tong Atack, who police say was 17 years old at the time of the incident.
According to a criminal complaint, Atack, along with the victim and several friends, were gathered at a west Ames residence on the night of April 20. The victim, who was reportedly 16 years old at the time, is said to have engaged in multiple sexual acts with Atack while at the residence.
Police say “videos depicting prohibited sex acts” were located in the “my eyes only” folder on Atack’s phone. The complaint also states that “other videos located…showed Atack filming himself and [the victim]” during the encounter.
Atack was arrested on July 3 and charged with Sexual Exploitation of a Minor – Cause to Engage in Act, a class “B” felony. Iowa criminal statute 728.12(1) says that “a person must know, or have reason to know, or intend that the act or simulated act may be photographed, filmed, or otherwise preserved in a visual depiction.”
Atack was booked at the Story County Jail and assigned a bond of $50,000. He was later released to pretrial supervision by the Iowa Department of Corrections.
According to court records, Atack appeared for an arraignment on Monday and entered a plea of not guilty. He was given a trial date of October 22, with a pretrial conference scheduled for October 14.
